We love seeing how everyone uses Kärcher products in their homes and outdoor spaces, and it’s a great way for us to inspire others. Your photo(s) or video(s) caught our eye so we’re hoping you’ll give us permission to be able to share it more widely.
By submitting your photo(s) or video(s) via responding to the message from any of our official Kärcher Limited social media channels with #YesKarcher, You represent and warrant that;
1. You are an individual aged eighteen (18) years of age or older;
2. You own all rights in and to your photo(s) or video(s) and it is not copied from any third party;
3. You grant us a non-exclusive, unlimited, assignable, sub-licensable, perpetual, worldwide licence, royalty free, revocable licence to use your photo(s) or video(s) for marketing and promotional purposes as digital and non-digital content, including but not limited to Kärcher-operated websites, third-party internet sites (partners, retailers, vendors, etc.), social media platforms, event activations, in-store materials, printed marketing, public billboards, advertisements, brochures, flyers, posters, postings, marketing promotional emails, internal communications, and in other marketing channels. We may exercise our rights anywhere in the world, and our licence is perpetual, meaning that it lasts for an indefinite period of time;
4. You grant us the licence to reproduce, display, perform, distribute, archive, adapt, modify, combine with other materials or edit your photo(s) or video(s) in any manner;
5. You grant us the right to use your username, social media handle, full name, photo(s) or video(s), likeness, caption or text, location or other identifying information in connection with any of your content for any purpose in any territory, in any media and in perpetuity;
6. You understand that we are under no obligation to publish your photo(s) or video(s) on our website or social media accounts;
7. The photo(s) or video(s) must not include or in any way contain: a) obscene or indecent material, including but not limited to nudity, pornography or profanity; b) defamatory content, including but not limited to words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group; c) threats to any person, place, business, group or world peace; d)must not invade privacy or other rights of any person, firm or entity, and must not in any other way violate applicable laws and regulations or network standards;
8. You have permission from any person(s) appearing in your photo(s) or video(s) to grant the rights set out in these Terms and Conditions;
9. You waive (or if waiver is not permissible by law, will not assert) any moral rights or other rights with respect to authorship or integrity of the photo(s) or video(s);
10. Use of your photo(s) or video(s) does not infringe the rights of any third party copyrighted works or trademarks and must not infringe the intellectual property rights of any third party or violate any applicable laws and regulations or network standards;
HOW DO I OPT OUT?
If You change your mind, You can simply revoke the granting of rights to Kärcher Limited by sending us an email to marketing.ie@karcher.com. We aim to respond to all requests within 7 working days. In reaching out to You about your photo(s) or video(s), we necessarily process your personal information (including your social media username, handle and/or byline). JURISDICTION/APPLICABLE LAW
To the maximum extent permitted by law, in no event will Kärcher Limited be liable for any damages, including but not limited to direct, indirect, incidental special consequential or punitive damages. You will indemnify, defend, and hold Kärcher Limited harmless from and against any claims, damages, liabilities, costs in connection with the use of the content. These terms will be governed by and construed in accordance with the laws of Ireland.
