1 THESE TERMS

1.1 These Terms govern your conduct associated with the Customer Review Service offered by Kärcher Ltd. (Ireland) (the “CR Service”).

1.2 To the extent of any conflict between Kärcher’s Privacy Policy and these Terms, these Terms shall control with respect to the CR Service.

1.3 By submitting your email address in connection with your review, you agree that Kärcher and its third party service providers may use your email address to contact you about the status of your review, any customer services related issues highlighted in your review and other administrative purposes.

2 RULES ON CONTENTS

2.1 By submitting any content to Kärcher, you represent and warrant that:

2.1.1 you have purchased the Kärcher product or services under review for your own use;

2.1.2 you are the sole author and owner of the intellectual property rights thereto;

2.1.3 all “moral rights” that you may have in such content have been voluntarily waived by you;

2.1.4 all content that you post is accurate;

2.1.5 you are at least 18 years old; and

2.1.6 use of the content you supply does not violate these Terms and will not cause injury to any person or entity.

2.2 You further agree and warrant that you shall not submit any content:

2.2.1 that is known by you to be false, inaccurate or misleading;

2.2.2 that infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;

2.2.3 that violates any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising);

2.2.4 that is, or may reasonably be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership or corporation;

2.2.5 for which you were compensated or granted any consideration by any third party;

2.2.6 that includes any information that references other websites, addresses, email addresses, contact information or phone numbers; or

2.2.7 that contains any computer viruses, worms or other potentially damaging computer programs or files.

2.3 You agree to indemnify and hold Kärcher (and its officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers, including but not limited to Bazaarvoice, Inc.), harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown including reasonable attorneys' fees, arising out of a breach of your representations and warranties set forth above, or your violation of any law or the rights of a third party.

2.4 For any content that you submit, you grant Kärcher a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world without compensation to you.

3 KÄRCHER'S USE OF YOUR REVIEW

3.1 All content that you submit may be used at Kärcher’s sole discretion. Kärcher reserves the right to change, condense or delete any content on Kärcher’s website that Kärcher deems, in its sole discretion, to violate the content guidelines or any other provision of these Terms.

3.2 Kärcher does not guarantee that you will have any recourse through Kärcher to edit or delete any content you have submitted. Reviews and written comments are generally posted within two to four business days. However, Kärcher reserves the right to remove or to refuse to post any submission for any reason.

3.3 You acknowledge that you, not Kärcher, are responsible for the contents of your submission. None of the content that you submit shall be subject to any obligation of confidence on the part of Kärcher, its agents, subsidiaries, affiliates, partners or third party service providers and their respective directors, officers and employees.

4 DATA PROTECTION DECLARATION

4.1 When you file an evaluation with us, we record your personal details. These details are your handle and your e-mail address as well as any further voluntary information regarding age, sex, address and household. By issuing an evaluation, you declare your consent to Kärcher or Bazaarvoice using your e-mail address to contact you regarding your evaluation status and other administrative matters. (Approval of the evaluation, information on the publication of your evaluation, any queries on your evaluation). The details provided by you will be used for processing your evaluation and additionally saved and processed for market research purposes.

4.2 The processing of your evaluation is carried out by Bazaarvoice Inc, 3900 N. Capital of Texas Highway, Suite 300, Austin, Texas 78746, USA. By issuing your evaluation, you declare your consent to your data being forwarded to the Bazaarvoice. Bazaarvoice uses these details exclusively for processing your evaluation.

4.3 You are authorised to retract your consent to the processing or use of your data at any time by sending an e-mail stating Product evaluation deletion of personal data in the subject line to info.ie@karcher.com. We will then delete your data as well as the product evaluation submitted.
